Welcome to www.spmf.org.sg, the website (the “Website”) of The Straits Times School Pocket Money Fund (“SPMF”). By your access of the Website and / or use of the functions (including the donation platform) available on the Website (the “Services”), you shall be deemed to have accepted these Website Conditions. These Website Conditions may be revised from time to time and revisions will be accessible on the Website. Your continued use of the Website after such revisions have been posted shall constitute your agreement to the revised Website Conditions.

1. You acknowledge that there may be interruptions in service or events beyond SPMF’s control that render the Website inaccessible. The Website may also be unavailable from time to time for any reason including but not limited to routine maintenance.

1. Your use of the Website must be for lawful purposes and comply with the Website Conditions at all times. To the extent that your conduct (as determined by SPMF in its sole discretion) breaches the Website Conditions, SPMF may deny you access to the Website and its Services, and seek other legal remedies or recourse.

   1. submitting any inaccurate information, committing fraud, or falsifying any information in connection with your use of the Services;

   10. using or reproducing the Website or any of its content in breach of copyright law;
   11. using any part of the Website or any of its content in any way which may:
       1. violate any law or regulation or any code of practice, direction, order or guideline issued by any regulatory or judicial authority;
       2. cause any loss or damage to SPMF or any third party including loss of reputation and goodwill;
       3. disrupt the operations and / or charitable activities of SPMF;
       4. create any liability for SPMF;
       5. cause SPMF to lose the services of any internet or telecommunication service provider or any other supplier of products and / or services; or
       6. engage in any other activity deemed by SPMF to be in conflict with the Website Conditions or its charitable objectives.
3. You shall be responsible for any connection or access to the Website by you or through your devices and internet service provider, and you are responsible for any charges (such as internet access charges) incurred by you thereon.

2. The trademarks, logos, and service marks (“Trademarks”) displayed on the Website are the property of SPMF or the respective third parties. You shall not use any Trademarks, including but not limited to as a hyperlink or in any advertising, without the prior written approval of SPMF and / or the respective third parties.
3. The contents of the Website are provided on an “as is” and “as available” basis. SPMF has used reasonable endeavours to ensure that any information and material provided on the Website are correct at the time of publication and provides no representations and warranties of any kind, express or implied, statutory or otherwise to the extent permitted under law.

6. Electronic Transactions

1. By engaging in electronic transactions (including the submission of donations) on the Website, you understand and agree that:
   1. you will adhere to all applicable laws relating to electronic communications and transactions;
   2. all electronic communications and transactions related to your use of the Website will be legally binding, valid, and enforceable, holding the same evidentiary weight as a signed written document;
   3. you will not dispute the legal validity or enforceability of any transaction or agreement conducted on the Website (including the Website Conditions) based solely on the fact that it was completed or conducted electronically; and
   4. all communications and transactions conducted or effected on the Website will be considered to have occurred within the Republic of Singapore.

SPMF cannot and does not assume responsibility for the content, policies or practices of such websites or the external parties which own or operate them. SPMF, its officers and staff shall not be liable or responsible for any loss or damage to the fullest extent permitted under law resulting from any access or use of the Website, including:-

1. any interruptions in services or any damage or loss of any kind suffered in connection with the use of the Website, including but not limited to denial or restriction of access to the Website;
2. any defect, default, deficiency or malfunction in any device, computer, internet service provider or telecommunication system or network, viruses or other malicious software or denial-of-service attacks that may affect the use of the Website;
3. any errors made by you in your use of the Services, including but not limited to the entry of inaccurate information; or
4. any interruption, corruption or cessation of transmission of data to or from the Website.

9. Indemnity

You agree to defend and hold SPMF, its officers and staff harmless from and against all claims, losses, damages, costs, and expenses, including legal fees on an indemnity basis, arising out of your use of the Website or any breach of the Website Conditions. In the event of any actual or threatened breach of the Website Conditions, SPMF may use or disclose any information relating to you to any third party or regulatory authority for the purposes of stopping and preventing any such breach.

10. General Terms

1. Waiver. No waiver of any breach or default shall be effective unless it is made in writing and signed by an authorised representative of SPMF. No waiver of any particular breach or default constitutes a waiver of any preceding or subsequent breach or default of the Website Conditions.
2. Reservation of Rights. Any delay or failure of SPMF to exercise any rights provided for in the Website Conditions will not be deemed a waiver of such right and is not a forfeiture of any similar or future rights provided for in the Website Conditions.
3. Third Party Rights. The Website Conditions apply equally to and are for the benefit of SPMF, its officers, staff, assignees and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.
4. Severability. If any term of the Website Conditions is held invalid by a court or arbitrator of competent jurisdiction, such invalidity shall not affect the enforceability of other provisions contained in the Website Conditions. The provision held invalid will be limited or eliminated to the minimum extent necessary so that the Website Conditions shall otherwise remain in full force and effect and enforceable.

6. Governing Law. The Website Conditions and any legal relationship arising from your use of the Website and its Services shall be governed by the laws of Singapore without regard to its conflict of law provisions, and you agree to submit to the exclusive jurisdiction of the Singapore courts.
